RICHMOND, Va. — When Virginia’s new marijuana laws go into effect on July 1, it will become legal for adults 21+ to carry up to an ounce of marijuana. It will also become legal to grow up to four marijuana plants (per household) in Virginia.
For the purpose of this chapter, “marijuana” means all parts of the plant of the genus Cannabis l., whether growing or not, with a THC concentration greater than 0.3 percent on a dry weight basis; the seeds thereof; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture or preparation of the plant, its seeds, or resin. It does not include the mature stalks of the plant, fiber produced from the stalks, or a cake made from the seeds of the plant, any compound, manufacture, salt, derivative, mixture or preparation of the mature stalks (except the resin extracted therefrom), fiber, oil, or case, or the sterilized seed of the plant which is incapable of germination. 9.40.080 Misdemeanor violations – Minimum penalties.
